A Florida couple purchased a home from Bank of America. Warren and Maureen Nygeres paid cash for the home located in the Golden Gated estates in Collier County FL, but that didn’t stop Bank of America from trying to foreclose on their home.
The couple contested the foreclosure with the help of a foreclosure lawyer, and after a year and a half the case was dropped. A Collier County Judge ordered Bank of America to pay couple’s legal fees since they were in error. Five months after the judgment the bank still hadn’t repaid the couple for the $2,500 legal costs.
The attorney for the couple, Todd Allen began proceedings to seize the bank’s property, an action the bank themselves would have done if the tables were turned. Last Friday, sheriff deputies brought a van to the bank and began to load up computers, desks, copiers and file cabinets even cash, according to Allen’s orders.
Faced with the police and a foreclosure attorney, the bank president was forced into action. The bank cut the couple a check for the amount owed and apologized for the delay, citing the lawyer contracted to handle the case was no longer in the business.
For the couple, who was wrongfully foreclosed this is vindication. There are a large number of homes across the countries that face wrongful foreclosure from negligent bank practices and mishandling of documents. Todd Allen said “As a foreclosure defense attorney, this is sweet justice.”
