Illegal dumping of asbestos occurs in New York wetlands

A New York state farm owner and a New Jersey construction company are being indicted for illegally dumping 30,000 tons of waste containing asbestos in protected wetlands.

Cross Nicastro, the farm owner, and the owners of Mazza & Sons, the Trenton based construction company, face charges of defrauding the United States, violating the Clean Air Act and environmental laws, as well as committing wire fraud. The defendants have pleaded not guilty.

Removal and disposal of asbestos is heavily regulated by the EPA because of the detriments it has to human health. Asbestos is the known cause of mesothelioma, asbestosis and other lung diseases. Mesothelioma is a form of lung cancer that causes tumors to grow on the linings of the lungs, heart and abdomen. The accused in the case fraudulently created a New York Department of Conservation document giving them approval to dump the asbestos. The area where the asbestos was illegally dumped has been covered and is scheduled for decontamination.
