New Jersey Governor Chris Christie has put a hold on implementing new medical marijuana legislation that was recently passed by the New Jersey legislative branch.
Federal prosecutors sent out a stern warning letter to all state governments whose laws allow for the cultivation and distribution of medical marijuana. Despite the fact that it would be legal to grow, sell and use medical marijuana under state law, federal law still strictly prohibits any such actions. Federal authorities pointed out that any instance of unlawful possession or distribution of marijuana would be met with penalties to the fullest extent of the law.
A memo recently circulated in the U.S. Justice Department stated that even state governments would not be immune to prosecution if they were found in violation of federal marijuana law.
Christie does not want to put New Jersey’s new medical marijuana laws into effect until he has assurance from the U.S. Justice Department that the NJ government and its workers will be protected from prosecution per the Controlled Substance Act.
With
New Jersey drug rehabs already having to assist thousands of NJ residents each and every year, many detractors of the new law are happy to see it put on hold. Christie’s critics might claim that he is blocking legislation that legally he should be obligated to enforce.
The New Jersey medical marijuana law was adopted just before Christie took office as governor.
