Supreme Court Rules that FDA Approval Cannot Prevent Dangerous Drug Lawsuits

The Supreme Court has ruled that federal approval of a drug does not provide protection from product liability lawsuits in state courts. This ruling upheld a $6.7 million jury ruling against Wyeth in a case involving a Vermont woman who lost her arm after an injection of Phenergan, an anti-nausea medication manufactured by Wyeth.

In this case, drug makers argued that lawsuits against defective or dangerous drugs were barred in state courts if the product was approved by the Food and Drug Administration (FDA). The court rejected this argument with a 6-3 ruling. This ruling protects the rights of people injured by dangerous or defective drugs to bring claims against the drug manufacturers and seek compensation.
