Madagascar’s Constitutional Court Backs Power Handover

Madagascar’s constitutional court has approved the transfer of power from President Marc Ravalomanana to opposition leader Andry Rajoelina despite questions concerning the legality of the handover.

Ravalomanana resigned his presidency following military pressure and outspoken criticism from Rajoelina and his supporters. Earlier this week the military stormed the presidential palace and Rajoelina took up office, declaring himself the country’s new leader.

While the military conferred the presidential powers to Rajoelina to Malagasy law clearly outlines protocol for a resigning president which stipulates power should be handed over to the head of parliament’s upper house and an election should be held within two months.

Questions concerning Rajoelina’s age have also been raised as the 34-year-old is six years too young to be elected president according to the constitution.

In a speech delivered from the capital city of Antananarivo Rajoelina pledged to hold elections within 18 to 24 months and return Madagascar to “normal life, to security and above all national reconciliation.”

The actions in Madagascar have been condemned by the African Union and Southern African Development Community which could suspend the membership of the country on the grounds of an unconstitutional change of government.
