John
Demjanjuk has received a stay of deportation and will not have to travel to
Germany to face war crimes charges he allegedly committed as a Nazi guard at the
Sobibor death camp during World War II.
The
family of Demjanjuk argued that the 89-year-old was too ill to travel yet U.S.
agents arrived at his home on Tuesday and, after carrying him out in his
wheelchair, placed him in a vehicle and began readying him for deportation.
That
deportation was halted in the last hour as the federal appeals court ruled in
favor of the family. Demjanjuk has denied the charges and has claimed that he
spent time as a prisoner of war after the Germans captured him in Ukraine.
Following
the end of WWI Demjanjuk entered the United States as a refugee but 25 years
later he was fingered as the infamous “Ivan the Terible” from the Treblinka
death camp and in 1981 he was stripped of his U.S. citizenship. In 1986 he was
extradited to Israel and in 1988 he was sentenced to death but in 1993 the Israeli
Supreme Court overturned the conviction after new evidence suggested he was not
“Ivan the Terrible.”
Demjanjuk
returned to the U.S. but in 2002 a judge ruled that there had been evidence he
had worked in a Nazi camp and his citizenship was stripped once again. In 2005
a judge ruled that he could be deported to Germany, Ukraine or Poland and last
month Germany issued an arrest warrant for him. U.S. agents arrived at his home
on Tuesday and were ready to carry out the deportation when the federal appeals
court stepped in.
