Tiffany Toribio Charged with Murder of ‘Baby Justice’

A 23-year-old woman has been charged with the murder of her baby son, who was found buried beneath the sand of a playground last Friday.

Police say Tiffany Toribio confessed to suffocating her 3-year-old son Ty, which the community named Baby Justice and Baby Angel because his body was so disfigured by the hot sand that authorities could not identify him.

Toribio was arrested about 4 a.m. Thursday morning after confessing to killing Ty. Toribio told police she suffocated Ty with her hand, but immediately regretted the decision and revived him with CPR. She then decided to suffocate him again.

“She placed her hand over her son’s mouth and nose and suffocated him. She had second thoughts about what she did. She performed CPR on her son, brought him back to life and then decided to go forward with that original act she had started to commit,” says Albuquerque Police Chief Ray Schultz. “What makes this story especially sad is, when asked the reason why she took Ty's life, Tiffany said that she did not want him to grow up with no one caring about him, the same way that she had grown up where nobody had cared about her.”

Toribio dug a shallow grave at the playground and buried Ty’s body. Her family contacted authorities after they released a description of the body.

Since her arrest, Toribio has attempted to commit suicide. She is being held in isolation at a detention facility. Toribio was charged with first-degree murder and abuse of a child under 12 that caused death among other charges.
