TiVo (NYSE: TIVO) To Receive $103 Million in Settlement with Dish Network

TiVo Inc. (NASDAQ: TIVO) won its five-year legal battle against EchoStar Communications Corp. (NASDAQ: DISH) and its DISH Network on Wednesday.

 

TiVo was granted a $103 million settlement in an East Texas court after a judge determined that Dish Network’s DVR copied software used by TiVo.

 

Dish now has to pay TiVo a royalty for its roughly four million DVRs, which could total as much as high as $4 per subscriber per month. The total could net TiVo $192 million annually in royalties, or $1.82 per share.

 

If Dish Network does not settle, they could revoke their DVR systems and possibly lose their 13 million subscribers.

 

According to Barron’s, Cablevision (NYSE: CVC) stated that it will develop a networked DVR, where TV programs can be replayed from its own servers, thus eliminating the need for a DVR. Both Cablevision and Time Warner Cable Inc. (NYSE: TWC) begin to focus more into that technology in a bid to avoid a licensing fee.

 

Cisco Systems, Inc. (NASDAQ: CSCO), which makes set-tops with integrated DVR functions, and Motorola (NYSE: MOT), face royalty claims as well, while Comcast (NASDAQ: CMCSA) the largest U.S. cable operator, already pays TiVo.

 

As of 3:54 pm, TiVo stock has shot up $3.58 to $10.57, which is a 51% increase. The stock price peaked at $10.83, which is its 52-week high.
