Partner and lead counsel Ryan Fisher of Lowe Eklund Wakefield & Mulvihill Co., LPA obtained a $2.3 million settlement for an elderly couple that was seriously injured in a motorcycle accident in Huron County.
In June 2010, a 71-year-old man and his 73-year-old wife were traveling in a three-wheeled Harley-Davidson® motorcycle along a rural road in Huron County in the early afternoon. While passing through an intersection, a man driving an SUV failed to see the motorcycle and rolled through the stop sign on the cross street. As the motorcycle slammed into the side of the SUV, the impact caused both plaintiffs to be thrown from their bike. They were both wearing helmets at the time. No drugs or alcohol were involved.
As a result of the accident, the husband suffered several broken bones and internal injuries that required multiple surgeries, as well as several hospital admissions and inpatient and outpatient rehabilitation. Due to his severely limited mobility, he spends most of his time in a wheelchair and can only walk short distances using a walker. The wife also suffered broken bones that required surgery in addition to a
traumatic brain injury. While the wife is still able to get around, her brain injury has left her with memory and speech problems.

The firm secured key evidence by obtaining security camera footage from a store on the corner that captured the accident on tape.

Fisher recently settled the case for $2.3 million. In addition to an upfront cash payout, the couple will also receive a portion of the compensation as a structured settlement so that they are guaranteed regular payments in the future.
