On behalf of 74 people alleged to be poisoned, the law firm of Newland & Newland LLP and Marler Clark are proceeding with a mass tort law suit in the Circuit Court of Du Page County in Illinois. The claims are for negligence, product liability and breach of warranty and was filed October 16 2011.
According to Trial Lawyer Gary A. Newland, the Shigella outbreak impacted so many and resulted in approximately 328 cases of food poisoning.
The Du Page County Health Department and the Illinois Department of Public health indicated at least one employee tested positive with the illness known as Shigella. According to Illinois Attorney Gary A. Newland, Shigella can be like salmonella on steroids and makes people very ill.
Often times the bacteria is spread through poor hygienic practices by employees.
Many of the injured parties are students of the chiropractic college in Lombard, Illinois where the Subway restaurant is located. Those students were not able to attend a great deal of class while recovering.
Mr. Newland stated at this time of budget cuts of local and federal governments the cash strapped governmental bodies are reducing enforcement.
Food poisoning is increasing at an alarming rate and the threat of lawsuits and increased insurance premiums on food producers and restaurants is what prevents the problem from increasing even more.
