National Association Proposes a 1 Year Wait for Divorce

A recent study has shown that a significant number of couples, who have filed for divorce, can reconcile of the process is slowed down so the couple can reconcile their differences. And this group has introduced a three point proposal aimed at state legislatures to delay divorce proceedings.

Irreconcilable differences are one of the primary reasons people hire divorce attorneys to initiate dissolution.

The Institute for American Values released their proposal called the “Second Chance Act,” which would require couples seeking divorce to wait a year before the divorce can be finalized. During that time, the party wishing to divorce can chose to send their spouse a letter stating their intentions before formally filing. Typically, when divorce lawyers file papers the process is moved along very quickly.

The year reprieve from litigation would allow the couples to work on saving their marriages, if that is what they chose to do. If they want to go through with the divorce, this year wait could be utilized to work on division of assets and determining conditions of child custody. Typically, couples work with divorce attorneys to settle these issues.

The proposal also requires the couple take education classes which cover the topics of reconciliation and how to divorce without conflict. Also, legislators would be asked to develop university based centers to provide education and resources for couple considering divorce.

The group argues that taking these steps could alleviate some of tax burdens caused by divorce.
