Tampa man on probation for DWI manslaughter facing second charge

A Bay area man who was released in March after spending four years in jail for DWI manslaughter.

On Saturday, Tampa police arrested 37 year-old Lamon Eugene Allen for Dui. They initially pulled him over for driving without his seatbelt, when they noticed he had glassy eyes and smelled of alcohol. He also performed poorly in field sobriety tests.

This alone isn’t enough to charge someone for DUI and a Tampa DWI attorney might be able to have the charges dismissed, but police tested his blood alcohol level. This test revealed that his blood alcohol content was between .184 and .168; in the state of Florida the legal limit is .08.

In 2005, Allen was driving while intoxicated when his Oldsmobile when he turned left into the path of a motorcycle. The motorcycle driver Leroy Mitchell was ejected from his bike when it slammed into the side of Allen’s car. Mitchell died as a result of this the accident. Allen’s blood alcohol level was .11 at the time of this collision.

He was sentenced to 5 years in jail and had just begun his ten year probation.
