Unpaid Overtime Claims from Day Rate Oil and Gas Workers Under Investigation

Class Action.org is investigating whether oil and gas employees who were paid using a day rate system were properly compensated for their overtime hours. It has been alleged that certain oil and gas companies violated wage and hour laws when they failed to pay day rate employees overtime compensation for time worked over 40 hours in a single workweek. If you have been denied overtime pay as a day rate employee in the oil and gas industry, you may be able to file a claim to recover up to twice the amount of overtime wages originally owed to you. To find out if you are eligible, visit http://www.classaction.org/day-rate-oil-and-gas-workers-overtime-lawsuits.html for a free, no obligation case review.

Under day rate pay laws, employers in the oil and gas industry are permitted to pay their employees a flat sum for a day’s work, regardless of the number of hours worked. However, many oil field and gas technical services workers who are paid using a day rate system are still entitled to overtime pay when working more than 40 hours a week. Under day rate overtime law, employees who may be entitled to time-and-a-half compensation can include the following: mud engineers; field coordinators; field engineers; service supervisors; pumpers and lease operators; tool pushers; tankermen; pipeline inspectors; and top drive technicians, assistants and mechanics. While compensating an employee with a flat sum for a single day’s work is allowable under federal wage and hour regulations, employers are still, by law, required to pay overtime compensation to eligible employees.

According to day rate overtime laws, when an oil or gas employee is denied overtime pay to which they are entitled, they may be able to make a claim for compensation. Potentially, these individuals may be able to file a claim for up to three years of unpaid overtime, an equal amount in liquidated damages, and attorneys’ fees. Several day rate overtime lawsuits have already been filed against oilfield service companies, and those looking to take a similar action to seek recovery of their unpaid overtime only have a certain amount of time to file a claim. Failure to act within this window will prohibit the employee from ever seeking compensation for their unpaid overtime.
