The Equal Employment Opportunity Commission has filed a lawsuit against Dad’s Barbeque restaurant alleging that an assistant manager and cook sexually harassed more than three employees, according to the Anniston Star.
The lawsuit was filed in the U.S District Court after the involved parties failed to reach an out of court settlement.
According to the lawsuit, the assistant manager, Carl McRath and cook, Cedric Bailey subjected the women to vulgar sexual talk, solicitations for sex and sexual touching. The women allege that the behavior was pervasive and made the workplace hostile.
Hostility in the workplace can cause a number of emotional issues and the harassed feel they must quit their jobs. The victims can hire a sexual harassment attorney to recover their financial losses caused by the harassment.
The only woman named in the lawsuit, Aretha Johnson, was also physically threatened by Bailey, who told her he would, “bust in your face, your husband and you whole family,” if she filed a complaint against him.
The women stated they informed restaurant management about the harassment but no action was taken. This is fairly common and the harassed will turn to the EEOC or a sexual harassment lawyer to force their employers to take actions against the accused.
For a sexual harassment case to actually go forward into litigation, the behavior must be pervasive and repeated. Sexual harassment attorneys work to prove this and make certain that the misconduct stops.
