Illinois Bar Association Offers Seminar on Social Security, Public Aid and Medicaid

The Northwest Suburban Bar Association (NWSBA), an Illinois bar association located northwest of Chicago, has a Civil Law Committee that is offering to educate attorneys on government reimbursement in third party injury cases on January 18, 2012.

The NWSBA is also offering 1 hour of Continuing Legal Education (CLE) Credit for members that attend the seminar on January 18, 2012. A guest lecturer Deborah Spector will be presenting a “Boot Camp” presentation on Social Security, Public Aid, Medicaid and their relationship to third party claims.  Recently, the NWSBA Civil Law Committee has offered several meetings on Medicare in relation to third party claims. Reimbursement for future medical treatment in third party cases is a perplexing area to most trial lawyers as it involves new legislation.  The NWSBA has approximately 600 members in Cook, Lake, McHenry and DuPage Counties. 

According to trial lawyer Gary A. Newland, workers’ compensation benefits and personal injury compensation have a direct impact on social security disability benefits. Those with Social Security Disability benefits are eventually entitled to Medicare regardless of age.  In light of Medicare claiming reimbursement for future payments as well as past conditional payments, it is essential to know how to protect the clients’ interests as well as Medicare. 

The recovery of compensation in an injury case may require reimbursement of Medicaid benefits paid and can also cause Medicaid benefits to be terminated.  In consequence, an injury settlement can result in the termination of medical benefits and therefore trial lawyers must be educated on how to advise their clients.

The Co-Chairs of the Committee Michael Rothmann and Gary A. Newland have been taking an active role in educating fellow members of the bar on issues pertaining to the government’s right to reimbursement in third party actions.
According to Gary A. Newland, although space is limited, the seminar is open to members and non-members. The subject matter is one of the hottest topics for trial lawyers throughout the country.  The response has been fantastic and indicates a need to further educate lawyers on set a sides and reimbursement issues.

The seminar will start at 5:30 on January 18, 2012.  The location will be 121 S. Wilke Rd 7th floor, Arlington Heights, IL 60005. It is necessary to RSVP as space is limited.
