Chief Judge Jonathan Lippman announced a new court initiative that will allow homeowners who have received default notices to obtain an Albany foreclosure attorney and have their dispute settled out of court to streamline the process. The new initiative was announced during his annual State of the Judiciary address on February 14th and will be tested first in New York City as reported by Reuters.
The deal between the state, legal service groups and four large banks-Wells Fargo, Citibank, Chase and Bank of America- will allow the foreclosure process to be streamlined.
Lippman said the court is trying to avoid scenarios that can delay the foreclosure process such as homeowners being told their paperwork in out of date or legal representation for banks claiming to have incomplete sets of documents.
Last year New York became the first state to require that lawyers for lenders must verify the accuracy of all mortgage documents.
Each week of the month will be assigned to a particular lender where all foreclosure disputes will be handled through conferences between the homeowners and bank attorneys.
